Temporary Protected Status (TPS) is a crucial measure that provides temporary relief to citizens of countries affected by conflict or natural disasters, allowing them to reside and work in the United States without fear of deportation.
In a significant decision, the Department of Homeland Security (DHS) announced on June 13, 2023, an 18-month extension of TPS for eligible Hondurans currently holding this status. This extension begins on January 6, 2024 and runs through July 5, 2025.
This move reverses the Trump administration’s proposed termination of Honduran TPS in 2018, which had been temporarily halted by several lawsuits until now. TPS offers its beneficiaries temporary immigration status, protection from deportation and permission to work in the United States.
Who is Eligible for Honduran TPS?
Current Honduran TPS holders who have lived in the United States since December 30, 1998 may apply for an extension of their TPS and work authorization.
However, the announcement does not include Hondurans who arrived in the United States and have resided here after that date.
How to Apply for an Extension of TPS?
On June 21, 2023, DHS published a notice in the Federal Register announcing the extension of Honduran TPS with instructions on how to apply.
Hondurans who currently have TPS must apply for an extension by filing the TPS application (Form I-821) between November 6, 2023 and January 5, 2024. It is recommended that the application be submitted during this time period, but no earlier than November 6, 2023.
Steps to Apply for the Honduran TPS Extension
Preparation of Documentation
Before filling out any forms, it is crucial to gather all the necessary documentation to support your application. This includes, but is not limited to, proof of identity (such as a passport), proof of Honduran nationality, and evidence of continuous residence in the United States since December 30, 1998.
2. Completion of Form I-821
Form I-821, “Application for Temporary Protected Status,” is the main document you must complete to apply for an extension of TPS. This form requests detailed information about your identity, immigration history, presence in the United States, and any other relevant aspects of your personal and immigration status.

3. Application for Work Authorization (Form I-765)
If you wish to renew your work permit along with your TPS, you must complete and submit Form I-765, “Application for Employment Authorization,” along with Form I-821. Even if you do not wish to work, it is recommended that you submit Form I-765 so that you have official documentation of your status.
4. Payment of Fees
Review the current fees required for processing Form I-821 and Form I-765 on the USCIS website. Fee waivers are available for certain applicants under specific conditions; be sure to check if you qualify for any of these waivers.
5. Application Submission
Submit your completed application (Forms I-821 and I-765, along with all supporting documentation and payment of fees) within the specified period, i.e., between November 6, 2023 and January 5, 2024. Be sure to follow the shipping instructions provided by the USCIS to avoid delays.
6. Follow-up and Updates
Once your application is submitted, you can track the status of your case through the USCIS website using the receipt number that will be provided to you. Be alert to any communication from the USCIS, as they may request additional information or call you for a biometrics appointment.

- Check Self-Extension Periods: If you already have work authorization under TPS, check the self-extension dates to ensure that your work permit remains valid while your extension application is being processed.

What About Work Authorization Extension?
To obtain proof of extension of your work authorization, you must file an application (Form I-765) for a new work permit valid until that date.
While you are waiting to receive your new work permit, your self-extended work authorization is valid until June 30, 2024.
Despite having received automatic work authorization, it is essential that those under Temporary Protected Status (TPS) apply for an extension if they want both their immigration status and their authorization to work in the United States to remain in effect until July 5, 2025. This step is crucial to ensure their continued legal stay and employability in the country.
Additionally, it is highly recommended to apply for a new work permit as part of your TPS extension application during the period between November 6, 2023 and January 5, 2024.
